These Terms and Conditions ("Terms") govern the purchase and use of services provided by Picme ("Picme", "we", "us", or "our") through the website picme.pics (the "Platform"). By purchasing a Picme package or using our services, you agree to be bound by these Terms.
If you are a consumer residing in the European Union or European Economic Area, the mandatory consumer protection laws of your country of residence apply alongside these Terms and are not overridden by anything contained herein.
Picme provides an AI-powered photo delivery platform that enables event organizers to distribute event photographs to guests through personalized galleries.
The platform uses automated facial recognition technology to match guest selfies to event photographs. This involves the processing of biometric data as defined under GDPR Article 9.
By using the guest-facing features of the platform, guests acknowledge that they will be directed to Picme's Privacy Policy and consent process before any biometric processing takes place.
The specific features, limits, and usage conditions of each package are described on the pricing page at the time of purchase.
All prices displayed on the Platform are shown in EUR and are exclusive of applicable taxes unless stated otherwise. Applicable taxes, including VAT where relevant, will be calculated and displayed at checkout before payment.
Picme packages are sold as prepaid packs and may include limits on:
Package details and pricing are clearly displayed before purchase and form part of this agreement.
Unless otherwise specified in the purchased package, photographs and related data will be stored for the duration indicated in the package description. After this period, Picme reserves the right to permanently delete stored photographs and related data without further notice.
Users agree not to upload content that is unlawful, defamatory, infringing of intellectual property rights, or otherwise harmful.
Picme reserves the right to remove content or suspend access to the Platform if such content is detected.
Payment is due in full at the time of purchase. Access to the purchased package is granted only after successful payment confirmation.
Picme reserves the right to modify pricing and package offerings at any time. Any such changes will not affect purchases already completed.
All sales are final. Once a Picme package has been purchased, no refunds, partial refunds, or credits will be issued, including but not limited to the following cases:
By completing a purchase, you expressly acknowledge and agree to this no-refund policy.
Consumers in the EU and EEA have a statutory right to withdraw from a purchase within 14 days of the transaction date under the EU Consumer Rights Directive (2011/83/EU).
Unused events that have not been activated may be refunded within 14 days of the original purchase date by contacting support@picme.pics. Once a refund request is received, Picme will process the refund within 14 business days to the original payment method.
Once an event has been activated, meaning photos have been uploaded or a guest link has been generated, that event is considered commenced and no refund, partial refund, or credit will be issued for that event, regardless of whether the full photo capacity or storage has been used.
By activating an event, you explicitly acknowledge that the service for that event has commenced and you expressly consent to waiving your statutory withdrawal right in respect of that activated event. All other package terms, including unused events within the same pack, remain unaffected by the activation of a single event.

You are responsible for ensuring that the selected package is suitable for your event needs before purchase. Picme is not responsible for limitations reached due to package constraints such as photo or storage limits.
As an event organizer using the Platform, you are responsible for ensuring that your use of Picme complies with all applicable laws in your jurisdiction, including data protection and privacy laws.
In particular, you are responsible for informing your guests that their photographs will be processed using facial recognition technology and for obtaining any consents required by law before directing guests to the Platform.
Picme provides a guest privacy notice template for this purpose, available on request.
While Picme strives to provide uninterrupted and reliable service, we do not guarantee that the Platform will be error-free or available at all times. Temporary interruptions may occur due to maintenance, updates, or factors beyond our control.
In the event of an extended or material service disruption caused by Picme, we will communicate with affected organizers via the email address associated with their account.
All intellectual property related to the Platform, including but not limited to software, design, branding, and trademarks, remains the exclusive property of Picme.
Nothing in these Terms grants you any rights in Picme's intellectual property beyond what is strictly necessary to use the Platform as intended.
Photographs uploaded by event organizers remain the intellectual property of their respective owners. By uploading photographs to the Platform, you confirm that you have the right to do so and grant Picme a limited, non-exclusive license to process those photographs solely for the purpose of providing the service.
To the maximum extent permitted by law, Picme shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of or inability to use the Platform, including loss of data, revenue, or business opportunities.
Nothing in this clause limits Picme's liability for:
Picme does not control and is not responsible for photographs or other content uploaded by Event Organizers or Guests.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia.
For consumers residing in the European Union, the mandatory consumer protection provisions of your country of residence also apply and are not affected by this clause.
Any disputes arising from these Terms shall be subject to the non-exclusive jurisdiction of the Estonian courts, without prejudice to your rights as a consumer to bring proceedings in your country of residence.
The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr for consumers wishing to resolve disputes out of court.
By purchasing and using the Picme platform, you as the event organizer acknowledge that you act as a data controller in respect of your guests' personal data.

Picme reserves the right to update these Terms from time to time. Where changes are material, Picme will notify customers with active or unused packages via email before the changes take effect.
Customers who have fully used their package are not entitled to notification because the contractual relationship has concluded.
Continued use of the Platform after notification constitutes acceptance of the revised Terms. The date of the most recent revision is noted at the foot of this document.
Picme reserves the right to suspend or terminate access to the Platform where a user violates these Terms or applicable laws.
